A. Parking Spaces Indicated for Persons With Disabilities. A parking space or stall for a person with disabilities shall be indicated by a vertical sign placed between 48 and 60 inches from the ground. The sign shall display the RCW 70.92.120 international symbol of access and include language indicating that vehicles parked in the space or stall without a license plate, placard or card described in this section may be impounded.

B. Parking for Vehicles Transporting Persons With Disabilities – Exception.

1. Vehicles transporting persons meeting the Chapter 46.19 RCW criteria for special parking privileges are allowed without charge to park in otherwise time-restricted parking zones or areas. To be eligible for this parking privilege, the vehicle must display the license plate, placard or card as described in Chapter 46.19 RCW.

2. This subsection B does not apply to parking zones or areas that prohibit all vehicles from stopping, parking or standing, or that restrict parking to special vehicle types.

C. Violations.

1. Improper Parking in a Space or Stall Indicated for Persons With Disabilities. No person may stop, stand or park a vehicle in a parking space or stall indicated for a person with disabilities for any purpose or length of time unless the vehicle displays the license plate, placard or card as described in Chapter 46.19 RCW.

2. Vehicles Blocking Access Aisles for Persons With Disabilities. No person may stop, stand, or park a vehicle to block or make inaccessible any access aisle or crosshatched area immediately adjacent to a parking space or stall indicated for a person with disabilities.

3. Vehicle Parking Within 20 Feet of Wheelchair Ramps. No person may stop, stand or park a vehicle within 20 feet of a wheelchair ramp on a public street unless lawfully parking in a space or stall indicated for persons with disabilities.

D. Penalties.

1. Infraction. Any violation of this section is an infraction with a maximum penalty of $300.00.

2. Vehicle Impound. The chief of police or designee may impound any vehicle:

a. Parked in violation of subsection (C)(1) of this section, whether the space or stall is on public property or on private property without charge; or

b. Parked upon a public right-of-way or other publicly owned or controlled property in violation of any other provision of this section.

The redemption of an impounded vehicle shall be governed by Chapter 46.55 RCW and other applicable law. (Ord. 6856 § 1 (Exh.
