In case any person or persons desire to establish, lay out, grade, regrade, construct or in any way improve any curb, street or sidewalk not provided for or covered by the adopted permanent grades, such person or persons shall petition the council in writing for the establishment of the proper grade, which petition shall set forth the exact location of the proposed improvement with the distances and any other information desired by the council, and the council shall make such order and take such action on such petition as shall be proper in the premises, and any grade established in addition to the above permanent grades shall be filed with the clerk and shall become a permanent grade for all purposes.
