A. Basis for Establishing the Areas of Special Flood Hazard.

1. The Special Flood Hazard Areas identified by the Federal Insurance Administrator in a scientific and engineering report entitled “The Flood Insurance Study (FIS) for King County, Washington and Incorporated Areas” dated August 19, 2020, and any revisions thereto, with accompanying Flood Insurance Rate Maps (FIRMs) dated August 19, 2020, and any revisions thereto, as well as the special flood hazard areas identified by the Federal Insurance Administrator in a scientific and engineering report entitled “The Flood Insurance Study (FIS) for Pierce County, Washington and Incorporated Areas” dated March 7, 2017, and any revisions thereto, with accompanying Flood Insurance Rate Maps (FIRMs) dated March 7, 2017, and any revisions thereto, are hereby adopted by reference and declared to be a part of this chapter. The FIS and the FIRM are on file at 1 East Main St, Auburn, WA 98001.

2. The best available information for flood hazard area identification as outlined in ACC 15.68.130(D) shall be the basis for regulation until a new FIRM is issued that incorporates data utilized under ACC 15.68.130(D).

3. Upon receipt of a floodplain development permit application, the floodplain administrator or designee shall compare the elevation of the site to the base flood elevation.

4. The floodplain administrator or designee shall inform the applicant that the project may still be subject to the flood insurance purchase requirements unless the owner receives a letter of map amendment (LOMA) from FEMA.

5. The floodplain administrator or designee shall make interpretations where needed, as to the exact locations of the boundaries of the SFHA and the Protected Area (e.g., where there appears to be a conflict between the mapped SFHA boundary and actual field conditions as determined by the base flood elevation and ground elevations) as it applies to proposed development. The applicant may appeal the floodplain administrator’s or designee’s interpretation of the location of the boundary to the hearing examiner for the city of Auburn. (Ord. 6761 § 1 (Exh. A), 2020.)
