The city shall have the power, from time to time, in an appropriate manner, to set forth and determine rules, regulations and rates, duties, responsibilities and necessary salaries, and such other matters as may be necessary in the discretion of its city council for the proper execution of this chapter. The city is empowered to carry out all the terms and provisions of this chapter and to collect and dispose of waste in the manner provided; however, the city shall not exercise such power if the city’s agent is faithfully performing any valid contract with the city, or unless the city purchases the property and franchise rights of the collector of waste.
