Other than where a person has been charged with this offense under circumstances where that person has previously been convicted of indecent exposure under this section or under RCW 9A.88.010, a person is guilty of indecent exposure if they intentionally makes any open and obscene exposure of their person or the person of another knowing that such conduct is likely to cause reasonable affront or alarm. Violation of this section is a misdemeanor unless the person committing the offense has exposed themself to a person under the age of 14 years, in which case it is a gross misdemeanor.
