When any public highway, road, street or thoroughfare within the city’s jurisdiction is either closed or restricted as to use, any person, firm or corporation disregarding such closure or restriction of use shall be guilty of an infraction with a penalty of $250.00, and it shall also be an infraction with a penalty of $250.00 for any person, firm or corporation to violate the requirements of this chapter; and in addition to any penalty for violation of provisions of this chapter, such person, firm or corporation shall be liable in any civil action instituted in the name of the city of Auburn for any damages occurring to any public highway, road, street or thoroughfare within the city’s jurisdiction as a result of disregarding such closure or use restriction.
