A. The hearing examiner, as established by Chapter 2.46 ACC, shall hear and decide appeals and requests for variances from the requirements of this chapter.

B. The hearing examiner shall hear and decide appeals when it is alleged there is an error in any requirement, decision, or determination made by the floodplain administrator or designee in the enforcement or administration of this chapter.

C. Those aggrieved by the decision of the hearing examiner may appeal the decision to the superior court of the county in which the project is located pursuant to ACC 2.46.160.

D. Upon consideration of the factors of ACC 15.68.250 and the purposes of this chapter, the hearing examiner may attach such conditions to the granting of the variance as he/she deems necessary to further the purposes of this chapter.

E. The floodplain administrator or designee shall maintain the records of all appeal actions and report any variances to the Federal Emergency Management Agency upon request. (Ord. 6761 § 1 (Exh. A), 2020.)
